Atty. Laird Heal Files Notice of Appearance
&
Motion to Continue Hearing
A Big Problem
Linda Shelton has retained Laird Heal as her new attorney, and that is a big problem for
3ABN president Danny Shelton. Why? Consider what Danny wrote in October 2006:

You are not in the mix. Your childish name calling has not
set well with a number of church leaders.You are obviously driven
by pride and trying to get your 15 minutes of fame. Every email
you send only makes you look more foolish for those of us who
know the truth. The final vote is now in the hands of church
leaders to decide. It will be fair. And notice will be given
to those involved, which does not include you.

Bob,
...
Gailon has access to a few people who worked there who have
an ax to grind and have told him twisted stories which are lies.
He's either not to bright or gullible, or is out to prove something
himself. ...
Gailon sees himself involved. He is delusional. He is not
involved. ...
God Bless!

Danny's dilemma now is how to keep Gailon Joy "not in the mix" and "not involved" when a circuit court of
the State of Illinois has recognized an associate of Gailon's as Linda's official attorney. Will he be able
to pull it off?
Fax Cover Sheet
Three times Attorney Heal mentions to the court the fact that Danny's attorney has not returned his
phone calls. The first reference in the Cover Sheet is more vague than the other two.

Dear Mr. Scott,
Please find enclosed for filing the following documents:
My Notice of Appearance on behalf of Linda Sue Shelton, Petitioner;
The Motion to Continue Hearing;
A Certificate of Service of same.
My apologies for the late date these are sent to you but I have,
as the Motion says, attempted to speak to opposing counsel on
this matter and despite all assurances from his office that he
was out of his office but would return the call, or that he was
shortly getting out of conference and would return the call,
he has not yet spoken with me.
I will contact you or your deputies regarding the same. I am
equally apologetic that I could not simply appear tomorrow but
there are conflicts in the next two days that prevent it.
Sincerely yours,
Laird J. Heal, Esq.

Atty. Heal's Motion to Continue Hearing
STATE OF ILLINOIS
IN THE CIRCUIT COURT OF THE SECOND JUDICIAL CIRCUIT
FRANKLIN, SS} |
Docket No. 05-D-30 |
|
IN RE: THE MARRIAGE OF
LINDA SUE SHELTON,
Petitioner,
vs.
DANNY LEE SHELTON,
Respondent.
|
|
MOTION TO CONTINUE HEARING |
NOW COMES LINDA SUE SHELTON, PETITIONER before
this Honorable Court, by and through her attorney LAIRD J. HEAL,
and asks that the hearing scheduled for April 11, 2007, be continued,
giving the following reasons:
(1) Substitute counsel has just been retained
and has not had time to familiarize himself with the case;
(2) The hearing date unfortunately conflicts with
counsel's schedule although he was going to be available during
the following week and generally thereafter;
(3) A party has the right to choose the attorney
to represent her and the motion before the Court speaks to the
failure to correctly represent one of the central issues in the
case, or at least represented it inconsistently;
(4) This counsel is unaware of an opposition to
the motion before the Court but has been informed that not all
pleadings and correspondence have been forwarded to the petitioner,
as she went through the case file and found items which she did
not recognize, and her attempts to meet with her attorney and
obtain a copy of the same have not as yet been successful;
[page 2]
(5) This counsel has placed numerous calls to
the attorney for the Respondent, either allowing a telephone
conference or to continue the hearing, and has not had the courtesy
of a single returned call or notification of when the attorney
would not be otherwise occupied and available to speak.
WHEREFORE, the petitioner asks this court continue
the hearing on the matter of striking the Petitioner s Answers
to Interrogatories and any other outstanding motions to a later
date which is convenient for the parties and counsel, and for
any other order or relief which the Court should be inclined
to issue or allow.
Respectfully submitted on behalf of
Linda Sue Shelton, Petitioner,
