Three Angels Broadcasting Network, Inc. (hereinafter "3ABN") and Danny Lee Shelton
(hereinafter "Shelton") (hereineafter collective "Plaintiffs"), as and for their Complaint against
Defendants Gailon Arthur Joy (hereinafter "Joy") and Robert Pickle (hereinafter "Pickle")
(hereinafter collectively "Defendants") do hereby state and allege as follows:
NATURE OF THE ACTION

PARTIES
Plaintiff Three Angels Broadcasting Network, Inc. is a non-profit
corporation organized and existing under the laws of the state
of Illinois, with its principle place of business located at
3391 Charley Good Road, West Frankfurt, Illinois 62896.
Individual Plaintiff Danny Lee Shelton is a resident of Illinois
and is the current President of Plaintiff Three Angels Broadcasting
Network, Inc.
Defendant Gailon Arthur Joy is a resident of Sterling, Massachusettes.
Joy is the register of the internet domain name "save3abn.com"
and, upon information and belief, is the host, author, and webmaster
of the internet web sites "www.save3abn.com" and "www.save3abn.org."
Defendant Robert Pickle is a resident of Halstad, Minnesota.
JURISDICTION
This court has original subject matter jurisdiction over this
matter pursuant to 15 U.S.C. §1121 as an action arising under
the Federal Trademark Act and pursuant to 28 U.S.C. §1338 as
an action arising under an Act of Congress related to copyright
and trademark. This court also has subject matter jurisdiction
over this matter pursuant to 28 U.S.C. §1332 as an action where
the matter in controversy is between citizens of different states
and the amount in controversy exceeds $75,000 (exclusive of costs
and interest).

Founded in 1985 and incorporated in 1986, 3ABN is an Illinois
non-profit corporation, the primary business of which is to operate
and manage a Christian television and radio broadcast ministry.
Plaintiff Shelton was an original founder of 3ABN and has been
continuously involved in the ministry and its operations since
its inception. Today, Shelton serves as President of 3ABN and
is one of 3ABN's on-air ministry and music presenters.
Although many of 3ABN's employees and volunteers, including
Plaintiff Shelton, are members of the Seventh-Day Adventist faith,
3ABN is a non-denominational Christian ministry which is not
owned by, affiliated with, or financed by any specific church,
denomination, or organization.

WHAT???
Hold on here — We have been deceived and should be given
our donations back. Donors have been solicited directly while
sitting in the very pews of local Seventh-day Adventist churches
and asked to support 3ABN with our financial donations as well
as letter writing campaigns to local cable television networks
in order to help advance the message of 3ABN. If it were not
a Seventh-day Adventist denomination supporting ministry (whether
or not legally owned by the church directly or a supporting ministry)
we would not have given funds to 3ABN. The only reason it has
had the wider support of the church membership is precisely because
we believed it was a supporting ministry of the Seventh-day Adventist
Church. If this is not the case then this fact needs to be made
known to any SDA church before it invites 3ABN into their sanctuary
on Sabbath. I dare say, there are thousands of SDA's who would
be willing to get up in court and testify to that fact to refute
the false statement made above in this frivolous lawsuit.
If you prevail against the defendants at Save3ABN.org in this
lawsuit, I fear someone will come forward and bring a class-action
lawsuit against 3ABN on behalf of all Seventh-day Adventist church
members who have donated to 3ABN since its inception who gave
under the misrepresentation of facts as stated above. I know
there are plenty of unscrupulous Christian-hating lawyers who
would be interested in taking on that case. The facts would
be on their side if the above statement in this lawsuit is true.
It would be a Pandora's box of trouble for 3ABN, all brought
on by Mr. Shelton in his efforts to continue to hide the truth
and not repent for his sins. It would be a bigger mess for
3ABN and do irrefutable harm to the SDA Church's worldwide
reputation. Oh how the devil works his magic. It starts with
the lies and deceit of one man at 3ABN and spreads around the
globe harming the good name and reputation of one of the true
Christian churches left in this world today.

Since its inception, Shelton and 3ABN have worked tirelessly
to promote 3ABN's ministry and to spread its unique, non-denominational
"Return to God" message. For over two decades, 3ABN has spent
countless hours and hundreds of thousands of dollars publicizing
itself through print and broadcast advertisements, special live
events, direct-mail campaigns, and

group presentations. While building a successful worldwide
ministry, Plaintiffs have also successfully built considerable
name recognition and goodwill for themselves and for their moniker
"3ABN."
Today, 3ABN is one of the larger Christian networks in North
America and, operating from its headquarters and primary production
facility in West Frankfort, Illinois, 3ABN broadcasts 24-hour
television and radio programming through a global satellite network
with potential viewers and listeners well into the millions.
In support of its global ministry, 3ABN also operates a production
facility in Nizhny Novogorod, Russia, and television facilities
in the Philippines and New Guinea.
As a provider of religious, spiritual and ministerial program
services, 3ABN depends upon its reputation for theological integrity,
operational capability, and financial soundness, in order to
attract new viewers and listeners, retain current viewers and
listeners, and sustain financial support for the ministry. 3ABN
relies extensively and almost exclusively on the donations of
viewers and supporters for its continued operation.

Mr. Shelton has done the major harm to both the reputation of
3ABN and to its financial soundness by his lying, cheating, stealing,
deceptive, adulterous behavior.

In January 2007, 3ABN discovered that Defendant
Joy had registered the domain name "save3ABN.com" with NamesDirect.com,
Inc. (hereinafter "Infringing Domain"). A copy of the registration
information for the domain name is attached hereto as Exhibit
F.

In March, 2007, 3ABN discovered that Defendant Joy
had registered the domain name "save3ABN.org" with NamesDirect.com,
Inc. (hereinafter "Directing Domain"). A copy of the registration
information for the domain name is attached hereto as Exhibit
G.

at the Infringing Domain URL that contains information factual about
3ABN's actions and operations, it contains true facts and supports
its allegations of criminal conduct by the organization with
actual documents and is not the reputation of the 3abn network
but is trying to save it from the damage and harm being continually
done by its founder, Danny Shelton.]

be likely to believe that the Infringing Domain and Infringing
Website originate with and are sponsored by 3ABN,

is not a 3ABN sponsored website. It is a website dedicated to
speaking the truth about all the corruption that has taken place
and the misuse of our donor money. Danny Shelton needs to REPENT
of his SINS against GOD, the SDA Church Family and the 3ABN Donors
who gave their money to the LORD ... not to go into the pockets
of Danny Shelton and his family!!!

but any such confusion could seriously injure 3ABN to the extent that the content
of the Infringing Website located at the Infringing Domain negatively
reflects upon the reputation, goodwill and character established
by 3ABN for its ministry, broadcast, and corporation over the
past 22 years. Because of the confusion engendered by Defendants'
unauthorized uses of the 3ABN Marks, 3ABN's valuable goodwill
with respect to its trademarks is jeopardized by Defendants.
The registration and/or the use and planned use
of the Infringing Domain by Defendant has been deliberate, designed
specifically to trade upon the enormous goodwill and familiarity
of the 3ABN Marks, in order to lure the public to a site that
disparages and defames

will come back into the donor fold.

3ABN? Adventist Today should be on your hit list! ... or how
about suing every Seventh-day Adventist church or church member
who speaks the truth about the problems at 3ABN? We are all
involved and concerned about these problems ... FYI there are
several million of us to sue then! And, you better sue the
Holy Spirit as he is directing many of us in our efforts to seek
a total house cleaning at 3ABN and getting rid of Danny Shelton
who is the focal point of the problems at 3ABN.]

himself by his poor behavior, by employing his pedophile brother,
by committing adultery, by violating the sanctity of marriage
by seeing a quickie divorce and remarriage to a woman his own daughter's
age, and by lying, cheating, and stealing from the employees
and supporters of 3ABN.]

of us (not associated with save3abn.org) have written the materials
on save3ABN not the defendants.]
Defendants have also participated in this conspiracy by jointly
marketing, advertising, and promoting the "www.save3ABN.com"
website, which they have done by posting electronic links to
the website on numerous bulletin boards and websites frequented
by members of the Seventh-Day Adventist Church, by mailing advertising
postcards to Seventh-Day Adventist Churches across the United
States directing Church Members to the "www.save3ABN.com" website,
and by encouraging Internet users to visit the "www.save3ABN.com"
website to "learn the truth" about 3ABN and its President Danny
Shelton.

If true, then Thank the Lord for doing that. Everybody needs
to know the truth of the problems at 3ABN before it brings GREAT
SHAME on the whole of the SDA Church.

Defendants have also participated in this conspiracy by each
disseminating, distributing, and reprinting the other's published
statements.
Defendants' Untrue Statements
Gailon Joy and Robert Pickle have published numerous untrue
statements that 3ABN and its President Danny Shelton have committed
financial improprieties with donated ministry funds. Among those
untrue statements made by Joy and Pickle are, inter alia, that:
For the last several years, the international television ministry
known as Three Angels' Broadcasting Network (3ABN) has found
itself beset by a growing number of moral, ethical, and financial
allegations. Despite the serious nature of these allegations,
repeated calls for investigation, reform, and accountability
have gone unheeded by its officers and directors.

TRUE ... the moral, ethical, and financial problems were mostly
caused by Danny Shelton and the information about them was initially
leaked by people INSIDE 3ABN who were employees or former employees
concerned about the corruption that was taking place inside 3ABN.
Thank the Lord for those wonderful people!

Danny Shelton purchased a 3-year-old van using 3ABN funds,
then sold the van to a member of his family for just $10.00.
|
I hadn't heard that one but it sounds like something Danny
would do given the other wrongs he has done. Thanks for giving
us more information about his wrongs. The situation is even
worse than we thought and it must be addressed ASAP by the highest
levels of the SDA church body.

Danny Shelton purchased new furniture with 3ABN funds, put the
new furniture in his residence, and put the old furniture from
his residence on the 3ABN television set.
|
This is true and has been documented by employees within the
ministry. I wouldn't go to court and press this issue ... truth
is on the side of the defendants in your frivolous law suit.
An article was published in Adventist Today where the employee
informed the church of this wrong doing.

Danny Shelton used 3ABN funds to purchase used furniture from
his sister, Tammy Chance, at nearly new prices (enabling Ms.
Chance to buy brand new furniture for her home), for use in a
3ABN guest house, but, instead of putting the used furniture
in the 3ABN guest house, Mr. Shelton gave the furniture to yet
another family member and used 3ABN funds to purchase brand new
furniture for the guest house.

Again, I hadn't heard this before but it sounds like something
Danny would do given the revelation of his true character by
emails he has written, wasting 3ABN ministry funds on this lawsuit
and his pathetic attempt to cast dispersions on others as a means
of deflecting focus from his own wrong doings.

The 3ABN Board of Directors has failed in its responsibility to oversee and manage 3ABN's financial assets.
|
Very true ... big time — They have failed in their fiduciary
duty to the donors to use the funds given to the ministry in
a wise and appropriate manner.

Danny Shelton laundered money through 3ABN donations to Cherie
Peters, in order to make payments that had been expressly prohibited
by the 3ABN Board of directors.

How many other shameful things has this man done???
Who will stop this madness and get rid of this thief???
Let's see, this story has a defrocked minister accused of being
a homosexual (think of the national media attention given to
Ted Haggard's troubles) and a pedophile (it gets even more attractive
to non-Christian media). Combined with a brother who through
nepotism and cover-up employed his family to help participate
in stealing ministry funds and possessions to be taken for their
own personal use, benefit and financial gain. Combined with
the fact that the ministry, not claiming to be a Seventh-day
Adventist supporting ministry, has stolen millions of dollars
by deception from the members of the very denomination from
which it gains its principal message and support. Add to it
the arrogance of Danny Shelton as exemplified by his emails full
of hate and vengeance against those who dare to speak the truth
and point out his failures. When combined with the audacity
and repugnance displayed by Mr. Shelton against his church's
own stricture against divorce by his quickie divorce in a Pacific
island nation — his third, yes third marriage — to a woman
just his daughter's own age. Close with his outlandish clothes
and use of a personal jet paid for by ministry donors. We have
a hit — the American people will love it. Satan approves.

3ABN Board members have personally enriched themselves as officers and directors of 3ABN in violation of the Internal Revenue Code.

Again, news to me but again it proves that a new board is desperately needed at 3ABN.

Danny Shelton wrongfully withheld book royalties from 3ABN and
refused to disclose those royalties in proceedings ...

True — he has entered into book royalty deals that benefited
him and were a financial burden on the ministry. In other words,
by his control of the ministry, he got it to enter into a deal
that was materially harmful to the ministry all while enriching
his own pockets — a very very shameful thing for anybody to
do but even more so when they are stealing from the Lord directly.

Danny Shelton has directed 3ABN Chief Financial Officer Larry
Ewing to not answer questions concerning Danny Shelton's personal
finances, expenses, bonuses or book royalties in a Family Court
...

How sad he continues to exert undue influence over persons beholden
to him for their livelihood. Thank goodness some people have
chosen not to continue to participate in his deceitful ways and
are willing to speak the truth.

Danny Shelton has used the 3ABN corporate plane for personal uses.

Why does 3ABN even have a corporate plane??? What an outrageous
waste of donor funds. Many publicly held companies in the United
States would never dare take on such an extravagant expense for
fear of stockholder reprisals ... which is exactly the trouble
Mr. Shelton has brought on himself with the donors.

Danny Shelton spent $600,000 of 3ABN funds for radio station
WDQN without Board approval and paid in excess of its fair market
value, which was only $250,000.

Sounds like an example of another poor business decision made
by Danny Shelton and allowed by the board because of their failure
to place proper oversight on 3ABN's finances.

and Defendants published them with malice, either knowing them
to be false or with wanton and reckless disregard for the truth

item number 47. The defendants have been called by the Holy
Sprit to bring forth the truth and shed light on the ills at
3ABN in order to save the Seventh-day Adventist Church from great
embarrassment because of the problems and wrongs Mr. Shelton
stands accused of doing.

Gailon Joy and Robert Pickle have published numerous untrue
statements that 3ABN and its President Danny Shelton have committed
administrative and operational improprieties at 3ABN and that
the organization is not properly or competently managed by its

made by Defendants are, inter alia, that:
3ABN engages in nepotism in the hiring and firing of staff.

3ABN violated the Federal Equal Opportunity Act by taking adverse
employment actions against two whistle-blower employees of 3ABN's

Adventist-related, fact-finding tribunal proposed and directed
by Adventist-laymen's Services and Industries ("ASI") to investigate
all allegations related to the ministry and confined the tribunal
to only those allegations involving Linda Shelton's removal and
the Shelton's' divorce.

will be uncovered before the whole world. He is doing everything
in his power to stop the truth from being told. If it weren't
for the efforts of brave people such as the defendants and others
within and outside of 3ABN, I bet God would have the rocks themselves

3ABN.

Gailon Joy and Robert Pickle have made numerous published untrue
statements that 3ABN and its President Danny Shelton acted without
grounds in removing Linda Shelton from the 3ABN Board of Directors,
that Danny Shelton had no grounds for divorcing Linda Shelton,
that 3ABN and Danny Shelton conspired to hide evidence and information
concerning the removal and divorce, and that 3ABN and Danny Shelton
have lied and made otherwise purposeful misstatements concerning
the Shelton's' divorce and Danny Shelton's remarriage. Among
those untrue statements made by Defendants are, inter alia, that:

Danny Shelton and ASI conspired to exclude Gailon Joy from participating
in a fact-finding tribunal regarding Linda Shelton's divorce
and removal from 3ABN.
Danny Shelton and ASI conspired to prevent various allegations
and issues from being included in the fact-finding tribunal.
It was Danny Shelton that participated in an extra-marital affair
by becoming "involved" in "after hours activities" with 3ABN
employee Brenda Walsh.

During his marriage to Linda Shelton, Danny Shelton had several
inappropriate extra-marital relationships, of which 3ABN staff
and board members were aware.
Danny Shelton was preparing to divorce Linda Shelton beginning in 2003.
Danny Shelton conducted an inappropriate relationship with from
August 2004 until they were married in 2006, and 3ABN's officers
and directors were aware of the relationship.
Danny Shelton lied by claiming to have joint title with Linda Shelton to a Toyota Sequoia automobile.
The 3ABN board of directors had no authority to authorize
Danny Shelton's adulterous marriage or to allow his continued
employment by and direction of 3ABN.
Danny Shelton perjured himself through the course of court
proceedings relating to his divorce from Linda Shelton.

What a sad example of the supposed sanctity of marriage these
days. It is behavior such as noted above that is the greatest
threat to the institution of marriage today ... not gay marriage
as Pastor Bachelor (Amazing Facts) and Pastor Nelson (Andrews
University) like to believe. Adultery — committed by married
heterosexuals — is the cause of the moral decline in the United
States. Not some silly queers — who make up less than 5 percent
of the population of the country — obtaining equal rights under
the laws of this country. Stop spreading your lies Pastor Bachelor
and Pastor Nelson and 3ABN by broadcasting It Is Written programs
focused on the horror of gay marriage. You heterosexuals are
responsible for the decline of family values in the United States
all by yourselves. Perhaps we need to bring back the laws of
stoning to death all heterosexuals caught in the act of adultery
... if "marriage" is so important and needs to be protected from

pride themselves on speaking about the horror of equal rights

a blind eye to the looming sexual perversion being done daily
by heterosexual church members.

Defendants' conduct as heretofore set forth evidences a malicious
and purposeful campaign of defamation, slander, and disparagement
intended and designed to embarrass, discredit, and defame 3ABN
and its President Danny Shelton and to vitiate, dishonor, and
impair the reputation and goodwill of 3ABN and its President
Danny Shelton.

Untrue — these statements are not meant to slander but to provide
for correction and reproof and allow Mr. Shelton the opportunity
to repent and ask forgiveness of those he has harmed.

COUNT I: Infringement of Trademark (15 U.S.C. § 1114)

Defendant Joy's unauthorized use of 3ABN's Marks is likely to
lead the public to believe the Infringing Website is associated
with, sponsored by, related to, affiliated with, or originates
with 3ABN when, in fact, it is not.

Again, just how stupid do you think people are??? — Intelligent
people such as yourselves should be embarrassed to even attempt
to put forth such a dumb argument. People know exactly the purpose
and intent of the Save3ABN website and that it is not a 3ABN
site. If they are as dumb as you think, then they wouldn't have
been able to get online in the first place!!!
[Wrong — the plaintiff(s) have been harmed by Mr. Shelton
and the spineless board of directors own stupid actions or lack
of action, as the case may be.]
Mr. Shelton has already caused harm to 3ABN by his sins.
The truth will be told one way or the other and you won't be
able to stop the truth — even if it takes public protest
in front of every Seventh-day Adventist church that 3ABN visits
and drawing in the local television media and perhaps, an investigative
reporter for a national media company. Be careful here Mr. Shelton
— you are advancing awareness of your problems further
by entering into this law suit. Shame on Pastor Bachelor and
the leaders of the Seventh-day Adventist Church for not stopping
this frivolous law suit and for not taking aggressive actions
to clean up the mess at 3ABN.
COUNT II: Dilution of Trademark (15 U.S.C. §1125(c)
Plaintiff restates and realleges Paragraphs 1 through 64 above,
and hereby incorporates them by reference, as though fully set
forth herein.

and are the cause of the willful dilution of 3ABN's Marks which
has injured the Plaintiff ... this will be proven at trial.]
[No — Danny's continued involvement with 3ABN is largely to blame for this problem.]
Danny Shelton's dilutive activities will continue unless enjoined
by the senior leadership of the Seventh-day Adventist Church
in Washington, DC, with respect to these continuing violations,
3ABN has adequate remedy in practice and at law to correct these
problems by dismissing Danny Shelton from 3ABN and taking legal
action against him to recover funds stolen or embezzled by him
and his family from the 3ABN ministry. He doesn't own 3ABN.
The board of directors, as fiduciary representatives of the
contributors of 3ABN, are the lawful persons responsible and in
control of the ministry. The new board needs to take aggressive
and immediate steps to ensure that this horrible mess is brought
to an end quickly before we see news reports about Mr. Shelton
and his pedophile brother on national television.
COUNT III: Defamation
Plaintiffs restate and reallege Paragraphs 1 through 71 above,
and hereby incorporates them by reference, as though fully set
forth herein.
Defendants have made numerous false statements of fact with regard
to both 3ABN and its President Danny Shelton.

at the website "www.save3ABN.com" and have thereby communicated
those false statements to someone other than the Plaintiffs.

Again with your lies and misstatements of fact. Wake up and
know that your client, the plaintiff, is guilty of all that he
is accused of doing wrong. If it were not so, then he would
have welcomed the ASI investigation into these allegations and
into the charges of adultery he advanced against his second wife.
can you believe it, the Seventh-day Adventist Church now actually
condones adultery by allowing this adulterer to be its principal
spokesman on world-wide television? Mrs. White must be turning
in her grave ... angels in heaven must be crying, and the devil
is laughing his *** off.

and the old board of directors have failed in their stewardship

Viewers have ceased support of the ministry and donors have reduced
or stopped donations to 3ABN precisely because of the harm Mr.
Shelton has done to the ministry himself, in and with the complicit
support of the worthless board of directors.

Facts (as it is now complicit in the evil deeds of 3ABN if it
fails to clean up this mess quickly). We, the past supporters
of 3ABN did not give our money to be used for the personal gain
by Mr. Shelton and his family. We gave our gifts to God to advance
his message. The old management and board of 3ABN have failed
to manage those funds properly. They are found wanting, weighed
in the balances as so eloquently written by others in correspondence
posted on Save3ABN.org and AToday.org.
